Cuba And U.S. Fight In Court Over Rum Trademark |

HAVANA ? There was the Cold War, the Bay of Pigs and the Cuban Missile Crisis, and there is still no end in sight to U.S.-Cuban animosity. Now a bitter dispute over a sweet-tasting spirit appears to be nearing an end game after more than a decade of legal wrangling.

Time and again U.S. courts have ruled against Cuba in its fight to control the U.S. rights to the trademark Havana Club, the island?s flagship rum brand that is sold in more than 120 countries around the world ? but not in the United States.

By mid-June, Cuba could lose all chance of pressing its legal claims against Bacardi, which distributes a limited quantity of its own Havana Club rum in Florida and says it plans to expand to other U.S. states in the near future.

Indignant over what it considers wholesale piracy of a national icon, Cuba accuses the U.S. of using an under-the-radar maneuver to block Cuba from paying the small trademark renewal fee, and has raised its concerns at increasingly high levels of government. If the trademark expires, Cuba says it could retaliate on U.S. trademarks currently protected on the island.

?The United States? disrespectful attitude in divesting the legitimate Cuban owners of the Havana Club brand can put at risk the brand and patent rights of American companies in our country,? Maria de los Angeles Sanchez, director of Cuba?s office of intellectual property, said Tuesday. ?Cuba reserves the right as a sovereign nation to act at the appropriate moment.?

Such retaliation might have limited immediate impact, as most U.S. goods are barred from being sold to the island under the 50-year-old U.S. embargo. However there are some legal sales of food items, and companies could also face tough and costly legal battles to win back their trademark rights in a post-embargo Cuba.

Although the U.S. sanctions prevent Cuba from marketing Havana Club in the United States, the island has held the trademark there since 1976 after the Cuban family that originally owned the brand let their registration lapse.

But since it came time to renew in 2006, Cuba says, it has been unable to do so because the U.S. Treasury Department?s Office of Foreign Assets Control, which enforces the embargo against the island, has not issued a license for Havana to make the $200 renewal payment.

Cuba sued the U.S. government, but lost. And when the U.S. Supreme Court declined to review the ruling on May 14, a 30-day countdown began after which the U.S. Patent and Trademark Office can cancel the trademark.

That means that as soon as June 13, Cuba?s claim to the name could expire, and with it the island?s best hope of continuing its legal battle.

Cuba has sent repeated diplomatic notes to Washington about the Havana Club trademark, but without yielding any result, Vice Foreign Minister Abelardo Moreno said.

U.S. government representatives declined to comment Tuesday. But in a written response to a question posed at a May 17 briefing, the State Department said the Office of Foreign Assets Control declined to license Cuban state-run export company Cubaexport to pay the fee, per policy guidance from State.

?Cubaexport was accorded and exercised a panoply of rights available to it under U.S. law,? the statement read. ?Cubaexport has had its day in court.?

The French company Pernod Ricard, which partners with Cuba to distribute Havana Club worldwide, vows the battle isn?t over.

?We are currently studying possible legal actions and studying the decision,? Olivia Lagache, general counsel for Havana Club, said by phone from Paris. ?We will still fight to keep this trademark alive.?

But the French spirits maker is also putting contingency plans into action. After the Supreme Court ruling, Pernod Ricard announced it had registered the brand name Havanista in the United States to sell rum there whenever the embargo is lifted.

The U.S. is an extremely lucrative market and home to some 40 percent of the world?s rum drinkers, who would likely jump at the chance to sip the light, dry rum, distilled through a process of charcoal filtering and oak-barrel aging to give it extra sweetness.

Havana Club offers a range of rums that go from just a few dollars to the ultra-high-end Maximo Extra Anejo, which retails for more than $1,200 a bottle.

Right now Bacardi dominates worldwide with 19.3 million cases of its rums sold in 2010, according to Impact Databank. That compares to 3.8 million cases of Pernod Ricard?s Havana Club sold in 2010, according to the French company.

Bacardi says it legitimately has the right to market Havana Club in the United States. The Bermuda-based company says it purchased global rights to the trademark in 1997 from the Arechabala family, the original owners who had let their registrations lapse. At the time, Bacardi was already embroiled in a legal dispute over its use of the name.

In rulings favoring Bacardi, courts cited 1998 U.S. legislation ? which Bacardi lobbied for and some call the ?Bacardi Bill? ? preventing lawsuits to enforce a trademark involving a company that was nationalized by Cuba. That same legislation also amended U.S. law so that such trademarks could no longer be renewed automatically, and required a specific license from the Office of Foreign Assets Control.

Pernod Ricard considers the legislation unfairly retroactive.

Bacardi applauded the Supreme Court decision. It said it has a trademark pending with the patent office since 1994, and is confident of gaining approval soon.

?Cuba does not have a valid registration,? said Patricia M. Neal, a spokeswoman for Bacardi USA. ?As a matter of law, the United States Patent and Trademark Office will formally cancel the registration of Cuba Export for the mark in due course.?

I knew we had to go big to kick off our newest segment, "BFFs." A companion of sorts to our popular "First Date," in this series, I get to hang out with some of our favorite women in entertainment, spending time with them as I would with my actual close girlfriends. So after watching Amber Rose on "RapFix Live," where she presented herself as strong, funny and candid, I knew she would be the perfect fit.

Rose held nothing back with MTV News' Sway Calloway during that interview a few months ago, and though her tears from a past heartbreak got quite a bit of coverage, one of the things I found most compelling about her was just how intensely love-struck she is once again.

She's very much in love with her fiancé — known to you and I as Wiz Khalifa (a man I became familiar with about two years ago, when I went on a "First Date" with him and his friend Curren$y) — and loves to show her affection for him however possible. If you tuned into the 2012 MTV Movie Awards on Sunday, you probably saw Amber beaming from the audience as Wiz put on an upbeat performance.

But Rose isn't just supportive of Wiz, she's also nurturing, doing things like cooking for him. I figured she and I could get to know each other a little bit better while furthering our culinary acumen, and so off we went on our friendship date to the Institute of Culinary Education.

In addition to her humble attitude and eclectic sense of style, I learned that morning that spending time with Amber Rose means you'll be laughing until your sides hurt. No less than three separate times during our shoot, we were forced to break to collect ourselves after she told a story, or we just started uncontrollably giggling, as girls do when they have a shared memory. (In our case, it was the mental image of Queen Latifah swinging on a cherry-picker crane in her video for "U.N.I.T.Y." Don't ask: Just know that it was our moment and everyone around was befuddled.)

The crew and I were in stitches when Amber related her most embarrassing moment, which took place back in her hometown of Philadelphia nearly 10 years ago.

"When I had hair, I had this weave ponytail that I used to put onto my real ponytail. And I grew up with two cats, Mitty and Fat Bettie," she began. "I go out one day, I put my little weave ponytail in. I think I look fly as f---," she continued, with a glimmer in her eye that either connoted how cool she in fact looked on that day or how silly she must have appeared — really, it could have gone either way. Upon meeting up with her friends, she caught a whiff of an unpleasant odor.

"I'm like, 'Uh uhhhhhh, one of y'all bitches smells like cat pee. This sh-- is f---ing gross!' " She paused for dramatic effect and then: "As I say that, I whip my ponytail around to walk away. My cat peed in my ponytail. ... And then I gagged, and I just went home."

With music, a wedding to Wiz Khalifa to plan and her incredibly fashionable life, it's always nice to look back and laugh.

US Navy hopes stealth ship answers a rising China

SINGAPORE (AP) ? A super-stealthy warship that could underpin the U.S. navy's China strategy will be able to sneak up on coastlines virtually undetected and pound targets with electromagnetic "railguns" right out of a sci-fi movie.

But at more than $3 billion a pop, critics say the new DDG-1000 destroyer sucks away funds that could be better used to bolster a thinly stretched conventional fleet. One outspoken admiral in China has scoffed that all it would take to sink the high-tech American ship is an armada of explosive-laden fishing boats.

With the first of the new ships set to be delivered in 2014, the stealth destroyer is being heavily promoted by the Pentagon as the most advanced destroyer in history ? a silver bullet of stealth. It has been called a perfect fit for what Washington now considers the most strategically important region in the world ? Asia and the Pacific.

Though it could come in handy elsewhere, like in the Gulf region, its ability to carry out missions both on the high seas and in shallows closer to shore is especially important in Asia because of the region's many island nations and China's long Pacific coast.

"With its stealth, incredibly capable sonar system, strike capability and lower manning requirements ? this is our future," Adm. Jonathan Greenert, chief of naval operations, said in April after visiting the shipyard in Maine where they are being built.

On a visit to a major regional security conference in Singapore that ended Sunday, U.S. Defense Secretary Leon Panetta said the Navy will be deploying 60 percent of its fleet worldwide to the Pacific by 2020, and though he didn't cite the stealth destroyers he said new high-tech ships will be a big part of its shift.

The DDG-1000 and other stealth destroyers of the Zumwalt class feature a wave-piercing hull that leaves almost no wake, electric drive propulsion and advanced sonar and missiles. They are longer and heavier than existing destroyers ? but will have half the crew because of automated systems and appear to be little more than a small fishing boat on enemy radar.

Down the road, the ship is to be equipped with an electromagnetic railgun, which uses a magnetic field and electric current to fire a projectile at several times the speed of sound.

But cost overruns and technical delays have left many defense experts wondering if the whole endeavor was too focused on futuristic technologies for its own good.

They point to the problem-ridden F-22 stealth jet fighter, which was hailed as the most advanced fighter ever built but was cut short because of prohibitive costs. Its successor, the F-35 Joint Strike Fighter, has swelled up into the most expensive procurement program in Defense Department history.

"Whether the Navy can afford to buy many DDG-1000s must be balanced against the need for over 300 surface ships to fulfill the various missions that confront it," said Dean Cheng, a China expert with the Heritage Foundation, a conservative research institute in Washington. "Buying hyperexpensive ships hurts that ability, but buying ships that can't do the job, or worse can't survive in the face of the enemy, is even more irresponsible."

The Navy says it's money well spent. The rise of China has been cited as the best reason for keeping the revolutionary ship afloat, although the specifics of where it will be deployed have yet to be announced. Navy officials also say the technologies developed for the ship will inevitably be used in other vessels in the decades ahead.

But the destroyers' $3.1 billion price tag, which is about twice the cost of the current destroyers and balloons to $7 billion each when research and development is added in, nearly sank it in Congress. Though the Navy originally wanted 32 of them, that was cut to 24, then seven.

Now, just three are in the works.

"Costs spiraled ? surprise, surprise ? and the program basically fell in on itself," said Richard Bitzinger, a security expert at Singapore's Nanyang Technological University. "The DDG-1000 was a nice idea for a new modernistic surface combatant, but it contained too many unproven, disruptive technologies."

The U.S. Defense Department is concerned that China is modernizing its navy with a near-term goal of stopping or delaying U.S. intervention in conflicts over disputed territory in the South China Sea or involving Taiwan, which China considers a renegade province.

China is now working on building up a credible aircraft carrier capability and developing missiles and submarines that could deny American ships access to crucial sea lanes.

The U.S. has a big advantage on the high seas, but improvements in China's navy could make it harder for U.S. ships to fight in shallower waters, called littorals. The stealth destroyers designed to do both. In the meantime, the Navy will begin deploying smaller Littoral Combat Ships to Singapore later this year.

Officially, China has been quiet on the possible addition of the destroyers to Asian waters.

But Rear Adm. Zhang Zhaozhong, an outspoken commentator affiliated with China's National Defense University, scoffed at the hype surrounding the ship, saying that despite its high-tech design it could be overwhelmed by a swarm of fishing boats laden with explosives. If enough boats were mobilized some could get through to blow a hole in its hull, he said.

"It would be a goner," he said recently on state broadcaster CCTV's military channel.
